These general terms of sale (the “T&Cs”) are proposed by MARBERA, registered under Trade License No. 1362658 / Company Registration No. 104765473400003, whose registered office is located at:

(the “Company”).
The Company publishes the website https://marbera.com (the “Web Site”).
MARBERA designs and sells high-end furniture and objects made of natural stone. All Products are manufactured on request in specialized workshops located in Italy, according to the Company’s specifications.
APPLICATION AND ACCEPTANCE OF THE T&Cs
These T&Cs govern all sales of Products offered on the Web Site.
By placing an order on the Web Site, the client acknowledges having read, understood and accepted these T&Cs without reservation.
The T&Cs applicable are those in force on the Web Site at the date the order is placed.
ORDERING PRODUCTS
Clients may create a personal account to facilitate future purchases. Clients are solely responsible for maintaining the confidentiality of their login credentials.
To place an order, clients select the Products, review their cart, enter delivery details and proceed to payment.
An order confirmation email will be sent to the client. Once confirmed, the order is final, firm and binding.
PRICES, TAXES AND PAYMENT TERMS
Prices displayed on the Web Site are expressed in euros (EUR).
Taxes and Duties
- For deliveries within the European Union, prices are displayed inclusive of applicable Value Added Tax (VAT) where required by law.
- For deliveries outside the European Union, prices are displayed exclusive of VAT. All customs duties, import taxes, local taxes, clearance fees and any other charges applicable in the country of destination shall be borne exclusively by the client.
MARBERA shall not be held liable for any delays, additional costs or refusals caused by customs authorities.
Incoterm DDP
By way of exception, should the client expressly request delivery under the Incoterm DDP (Delivered Duty Paid), applicable duties and taxes may be included in the total price, subject to prior written confirmation by MARBERA and acceptance of a specific quotation.
Payment
Orders are payable in full at the time of ordering by credit card unless expressly agreed otherwise by MARBERA.
Payments are processed via secure payment systems provided by Shopify and its authorized payment service providers. Banking data is encrypted and not stored by MARBERA.
MARBERA reserves the right to suspend or cancel any order in the event of non-payment, payment incident, fraud or attempted fraud.
MANUFACTURING, AVAILABILITY AND DELIVERY
Manufacturing
All Products are manufactured on request using natural stone materials.
Due to the handcrafted process and the inherent characteristics of stone, variations in color, veining, texture, translucency, thickness or finish are natural and do not constitute defects.
Delivery
Deliveries are made to the countries listed on the Web Site.
Delivery consists of placement of the Products on a pallet at the entrance of the delivery address. Interior delivery, installation, lifting or handling inside buildings are excluded unless expressly agreed upon through a specific quotation accepted by the client.
Clients are responsible for ensuring full accessibility of the delivery location (access roads, doors, stairs, elevators).
MARBERA shall not be held liable for delays caused by force majeure, transport constraints, customs procedures or circumstances beyond its control.
ACCEPTANCE OF PRODUCTS
Clients must inspect the Products immediately upon delivery.
Any damage or non-compliance must be:
- clearly stated on the delivery slip,
- supported by precise written reservations,
- accompanied by photographic evidence.
Any claim must be submitted within 3 calendar days following delivery. Claims not complying with these conditions may be refused within the limits of applicable law.
NO RIGHT OF WITHDRAWAL – NO CANCELLATION
Products sold by MARBERA are manufactured on request and/or customized.
No right of withdrawal, cancellation or refund applies once an order has been confirmed, except where such a right is mandatorily imposed by applicable consumer protection laws.
In all cases:
- Return shipping costs are borne exclusively by the client.
- Products must be unused, undamaged and returned in their original packaging.
- Products showing signs of use, installation, damage or alteration shall not be eligible for any refund.
LIABILITY
MARBERA shall not be liable for damage resulting from misuse, improper handling, improper installation, inadequate flooring, lack of maintenance, normal wear or external impact.
Natural stone is a living material. Micro-cracks, fossils, veins, color variations and structural differences are inherent characteristics and do not constitute defects.
PERSONAL DATA – PRIVACY POLICY
Personal data collected via the Web Site is processed by MARBERA, acting as data controller, whose registered office is located at the address stated above.
Personal data is hosted by Shopify Inc. and its authorized service providers, located in Canada and other jurisdictions, in accordance with applicable data protection regulations.

INTELLECTUAL PROPERTY
All content on the Web Site is the exclusive property of MARBERA. Any reproduction or use without prior written consent is strictly prohibited.
APPLICABLE LAW AND JURISDICTION
These T&Cs are governed by the laws of the United Arab Emirates.
Any dispute relating to the interpretation or performance of these T&Cs shall fall under the exclusive jurisdiction of the competent courts of Dubai, unless mandatory legal provisions provide otherwise.
